- INTRODUCTION
These Terms and Conditions (“Terms”) govern the use of services provided by DestinoDen Travels Private Limited (hereinafter referred to as “Company”, “We”, “Us”, or “Our”), a private limited company registered CIN:U79110DL2025PTC455345 under the Companies Act, 2013, and operating from Delhi, India.By booking any tour package or service with DestinoDen Travels Private Limited, you (“Customer”, “You”, or “Your”) agree to these Terms and Conditions
- DEFINITIONS
- “Booking” means the reservation of any tour package, service, or accommodation through the Company.
- “Tour Package” refers to domestic travel packages offered by the Company, including but not limited to accommodation, transportation, sightseeing, and other related services.
- “Confirmation” means the written acknowledgment by the Company of acceptance of a booking.
“Force Majeure” includes natural disasters, acts of God, war, terrorism, civil unrest, government restrictions, pandemics, strikes, or any other event beyond reasonable control.
- BOOKING AND PAYMENT
3.1 Booking Process
- All bookings must be made through our authorized channels: website, email, phone, or office visit.
- A booking is confirmed only upon receipt of the required advance payment and issuance of a booking confirmation by the Company.
3.2 Payment Terms
- Advance Payment: A minimum of 25-50% of the total tour cost (as specified in the package details) must be paid at the time of booking.
- Balance Payment: The remaining balance must be paid in installments as scheduled before the tour departure date.
- Failure to make payments as per the schedule may result in automatic cancellation of the booking.
3.3 Payment Methods
- Payments can be made via bank transfer, credit/debit card, UPI, or other authorized payment methods.
- All payments must be made in Indian Rupees (INR).
3.4 Price Validity
- All prices quoted are valid for the period specified in the quotation or package details.
Prices are subject to change without prior notice until full payment is received and booking is confirmed.
4. CHANGES AND MODIFICATIONS
4.1 Changes by Customer
- Requests for changes to confirmed bookings (dates, destinations, or services) must be made in writing.
- Changes are subject to availability and may incur additional charges.
- Changes requested within 15 days of departure may not be possible.
4.2 Changes by Company
- The Company reserves the right to modify itineraries, accommodation, or services due to operational requirements or circumstances beyond control.
- Customers will be informed of significant changes as soon as possible.
- No refund will be applicable for minor itinerary changes or substitutions of similar standard.
5. TRAVEL DOCUMENTS AND REQUIREMENTS
5.1 Customer Responsibilities
- Customers must carry valid photo identification (Aadhaar Card, Passport, Voter ID, Driving License, etc.) during the tour.
- For certain destinations, additional permits or documents may be required. Customers are responsible for obtaining these in a timely manner.
- The Company will assist in obtaining necessary permits where applicable, but is not responsible for delays or rejections.
5.2 Accuracy of Information
- Customers must provide accurate personal information (name, age, contact details, etc.) at the time of booking.
- The Company is not liable for any issues arising from incorrect information provided by the customer.
6. TRAVEL INSURANCE
- Travel insurance is strongly recommended and may be mandatory for certain packages.
- The Company can facilitate travel insurance arrangements but is not responsible for any claims or disputes with insurance providers.
Customers should carefully review insurance coverage and terms before purchase.
7. ACCOMMODATION AND SERVICES
7.1 Accommodation Standards
- Accommodation will be provided as per the package category booked (budget, standard, deluxe, luxury, etc.).
- Room allocation is subject to availability and hotel policies (check-in/check-out times, room types, etc.).
7.2 Meal Plans
- Meals included in the package will be as specified in the itinerary.
- Special dietary requirements should be informed at the time of booking; the Company will make reasonable efforts to accommodate but cannot guarantee availability.
7.3 Transportation
- Transportation will be provided as per the itinerary using vehicles appropriate to group size.
- The Company is not responsible for delays due to traffic, weather, or other unforeseen circumstances.
8. CUSTOMER CONDUCT AND RESPONSIBILITIES
8.1 Behavior and Conduct
- Customers are expected to conduct themselves in a respectful and lawful manner throughout the tour.
- The Company reserves the right to terminate services without refund if a customer’s behavior is deemed disruptive, illegal, or harmful to others.
8.2 Health and Fitness
- Customers must ensure they are medically and physically fit for the tour activities.
- Any pre-existing medical conditions must be disclosed at the time of booking.
- The Company is not liable for health issues arising during the tour.
8.3 Personal Belongings
- Customers are responsible for their personal belongings, valuables, and travel documents.
- The Company is not liable for loss, theft, or damage to personal property.
9. LIABILITY AND INDEMNITY
9.1 Limitation of Liability
- The Company acts as an intermediary in arranging accommodation, transportation, and other services through third-party suppliers.
- The Company is not liable for any loss, injury, damage, delay, or inconvenience caused by third-party service providers.
- The Company’s liability is limited to the amount paid for the tour package.
9.2 Force Majeure
- The Company shall not be liable for failure to perform obligations due to Force Majeure events.
- In such cases, the Company will provide reasonable assistance but is not obligated to provide refunds for unused services.
9.3 Customer Indemnity
- Customers agree to indemnify and hold harmless the Company, its employees, and agents from any claims, damages, or expenses arising from their actions or negligence.
10. COMPLAINTS AND GRIEVANCES
10.1 Reporting Issues
- Any complaints or issues during the tour should be immediately reported to the tour manager or Company representative.
- The Company will make reasonable efforts to resolve issues promptly.
10.2 Post-Tour Complaints
- Written complaints must be submitted within 7 days of tour completion via email.
The Company will investigate and respond within 15 working days.
11. INTELLECTUAL PROPERTY
- All content on the Company’s website, brochures, and promotional materials (including text, images, logos, and designs) are the intellectual property of DestinoDen Travels Private Limited.
- Unauthorized use, reproduction, or distribution of such content is prohibited.
12. GOVERNING LAW AND JURISDICTION
- These Terms and Conditions shall be governed by and construed in accordance with the laws of India.
- Any disputes arising from these Terms or services provided shall be subject to the exclusive jurisdiction of the courts in Delhi, India.
13. AMENDMENTS
- The Company reserves the right to modify these Terms and Conditions at any time without prior notice.
- Updated Terms will be posted on the Company website and will be effective immediately.
- Customers are advised to review the Terms periodically.
14. SEVERABILITY
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
15. ENTIRE AGREEMENT
These Terms and Conditions constitute the entire agreement between the Customer and DestinoDen Travels Private Limited and supersede all prior agreements, understandings, or representations.
